Please read carefully. It's important that you understand exactly how the domyflor service works.

Article 01

Definitions

For the purposes of these Terms and Conditions, the following definitions apply:

  • domyflor: the digital platform accessible at www.domyflor.com.
  • User / Customer: any person who accesses the platform to purchase flowers, plants, or floral arrangements.
  • Partner Florist: the professional selected by domyflor and present on the platform.
  • Order: the purchase request made by the User through the platform.
  • AI Configurator: the optional tool for visualizing floral arrangements.
Article 02

The domyflor service

domyflor is a digital connection hub between customers and selected artisan florists. The platform does not sell flowers or plants directly, nor does it manage its own inventory.

  • Selects and verifies Partner Florists according to internally defined quality criteria
  • Provides Users with a space to discover florists in their area
  • Provides Partner Florists with the technological tools to manage their own shop
  • Optionally offers the AI Configurator to participating Partner Florists

Important: the sales contract is established exclusively between the User and the Partner Florist. domyflor is not a party to the sales contract.

Article 03

Limitation of Liability and Indemnification

domyflor operates as a technology infrastructure provider and does not intervene directly in the order fulfillment process, which is the sole responsibility of the Partner Florist. domyflor therefore assumes no liability for:

  • Order fulfillment: any delivery delays attributable to the Partner Florist or to force majeure events
  • Product conformity: any discrepancy between the preview generated by the AI Configurator and the actual arrangement, as well as the possible unavailability of specific flowers at the time of preparation
  • Transport and condition: damage to products caused during transport or delivery
  • Health: allergic or physical reactions resulting from contact with the delivered floral products

Indemnification Clause — The User and the Partner Florist acknowledge that domyflor acts exclusively as a technological intermediary. Accordingly, the Partner Florist agrees to indemnify and hold domyflor harmless from any claim, damage, liability, or expense (including legal fees) arising from claims raised by end customers regarding the performance of the service. domyflor shall be liable for any service failures solely and exclusively in cases of willful misconduct or gross negligence in the management of the security of its own systems.

Article 04

Payments

Payment for orders is made directly to the Partner Florist using the payment methods they have enabled.

  • Prices displayed on each storefront are set independently by the Partner Florist
  • domyflor is not responsible for any pricing errors displayed by the Partner Florist
  • Refund procedures in case of cancellation are determined by the Partner Florist

Every transaction is protected by the payment systems adopted by the Partner Florist.

Article 05

Delivery

Delivery zones, costs, and times are determined independently by each Partner Florist.

  • Always check the Partner Florist's delivery zones before placing an order
  • Same-day delivery is subject to the florist's availability and hours
  • domyflor does not manage or organize deliveries
  • In case of a missed delivery, contact the Partner Florist directly

Florist selection and removal

domyflor reserves the right to select, accept, or remove a Partner Florist at any time.

  • Average verified reviews on third-party platforms
  • History and reputation of the shop in its local area
  • Quality of products and arrangements
  • Reliability and punctuality in deliveries
  • Compliance with domyflor's partnership terms

Privacy and personal data

domyflor processes personal data in compliance with EU Regulation 2016/679 (GDPR).

  • Manage coverage-check requests and contacts with the platform
  • Improve the platform's user experience
  • Fulfill legal obligations

This Privacy Policy describes how the personal data of users who register on our SaaS (Software as a Service) platform, accessible at domyflor.com and the network's related sub-sites, is collected, used, and protected.

This notice is provided pursuant to Article 13 of European Regulation 2016/679 (GDPR) and applicable Italian law.

1. Data Controller

The Data Controller for the processing of data related to the management of the platform and the accounts of registered users is:

2. Roles in Data Processing (Multisite SaaS Model)

Since domyflor is a multisite platform that hosts services on behalf of third parties, it is necessary to clearly distinguish the legal roles:

  • domyflor as Controller (Data Controller): We act as Data Controller solely for the data of users who create an account on the platform (the SaaS subscribers/customers) and for browsing data on the main domyflor.com site.
  • domyflor as External Processor (Data Processor): With regard to the data of end customers who browse or make purchases on the individual sub-sites managed by subscribers (e.g., bouquet order forms for customers of "SUB-SITE FLORIST"), domyflor acts merely as a technology provider and host of the server infrastructure (External Processor), while the subscriber who owns the sub-site remains the exclusive controller of that data.

3. Types of Data Collected and Purposes

domyflor collects and processes the following personal data of platform subscribers for the purposes indicated:

  • Registration and Account Data: First name, last name, email address, login credentials. Purpose: Account creation and management, access to SaaS features, service communications regarding the status of the application.
  • Billing Data: Company name, VAT number/Tax Code, registered office address, payment data (via external gateways). Purpose: Management of SaaS subscriptions, legal tax and accounting compliance.
  • System Logs and Application Usage: IP addresses, access timestamps, actions performed in the control panel. Purpose: Network security monitoring, prevention of fraud or cyberattacks, software performance optimization (Legitimate interest of the Controller).

4. Data Processing through Artificial Intelligence (AI Act Compliance)

The technological core of the domyflor platform includes an Artificial Intelligence (AI) system for generating synthetic content (graphic previews of floral bouquets). In compliance with EU Regulation 2024/1689 (AI Act), please note that:

  • Input Data: The system processes only the objective choices entered by the user (e.g., flower type, color, arrangement style) to generate the graphic output. No biometric or sensitive data is requested or processed through the AI algorithm.
  • Use of APIs: Where the software interfaces with third-party artificial intelligence providers via API keys, domyflor ensures that the input data sent is not used by third-party providers to train public generative models.
  • Transparency: Users are informed within the graphic interfaces that the images displayed are entirely generated by an automated system.

5. Legal Basis for Processing

We process subscribers' personal data only when one of the following legal conditions applies:

  • Performance of the contract (Art. 6.1.b GDPR): For the provision of the SaaS service and the creation of the requested multisite.
  • Legal obligation (Art. 6.1.c GDPR): For the billing of subscriptions.
  • Legitimate interest (Art. 6.1.f GDPR): To ensure the platform's IT security (e.g., access logs protected by two-factor authentication, 2FA).

6. Advanced Security Measures

domyflor adopts rigorous technical and organizational security measures to prevent the loss, unlawful use, or unauthorized access to data across the entire network. These include:

  • Encryption of data in transit via HTTPS/SSL protocol.
  • Mandatory Two-Factor Authentication (2FA) for all administrative access to the main site and sub-sites.
  • Continuous log file monitoring systems for the timely detection of potential Data Breach attempts.

7. Disclosure of Data to Third Parties

Subscribers' data is never sold to third parties. It is disclosed only to providers strictly necessary for managing the SaaS:

  • Hosting/Cloud Providers: For hosting the multisite's servers and database within the European Economic Area (EEA).
  • Payment Gateways (e.g., Stripe/PayPal): For managing recurring subscription payments.
  • Tax Advisors: For managing the parent company's accounting.

8. Data Retention

Account data remains active until the subscription is cancelled or the user requests account closure. Accounting data and invoices are retained for 10 years in compliance with Italian civil and tax obligations.

9. User Rights (Articles 15 et seq. GDPR)

Subscribers may exercise their rights at any time by writing to info@domyflor.com. You have the right to request access to your data, rectification, erasure (where this does not conflict with tax obligations), restriction of processing, or to lodge a complaint with the Italian Data Protection Authority (Garante per la Protezione dei Dati Personali, www.garanteprivacy.it).

Article 09

Changes to these terms

domyflor reserves the right to modify these Terms at any time. Changes take effect from the date of publication.
